I have a MFJ couple. 66 year old and 58. The 66 year old is the only wage earner, he also has non taxable social security. The program is calculating EIC. Is this correct? I understand only one has to be under the age of 65 but the one under 65 has no income. There is also non-taxable social security. When added to the W2 they are over the limit. Am I over thinking or am I correct that they do not qualify. If I am correct how do I opt out of EIC.

    It does not matter which spouse is under age 65, so EIC is correct.

    Non-taxable Social Security does not affect EIC.
