Married Jointly to Single

I am unsure on how to file this.

 

Primary taxpayer amends from Married J to Single.

 

Secondary taxpayer files an amended tax return as well? And how is this prep’d?

Do I complete a second identical return matching the original and with the secondary taxpayer as primary? And then prep the amendment?

 

In all my years filing amendments this situation is a first for me.

You cannot amend a MFJ to single after due date of return. from IRS instructions.

In general, you can’t change your filing status from a joint return to separate returns after the due date of the original return. Link, https://www.irs.gov/pub/irs-prior/i1040x--2024.pdf

OP is saying amend from MFJ to Single. Not MFJ to MFS.

The more I know the more I don’t know.

@sjrcpa My reply to poster says you can’t amend MFJ to single. As a side note poster didn't say if clients were married or not, so I would think  they were married. If married you have two choices, MFJ or MFS, and if original returned filed as MFJ you cannot amend after due date of return

If no longer legally married 12/31/2025, yes you can make the amendment. But you  should also do 1040X for SP. 

I’d make ‘save as’ copies of the original for ‘amendTP’  and ‘amendSP then follow the normal amendment workflow. S/B able to efile

If at first you don’t succeed…..find a workaround
