Is there any recourse if an employer will not correct a w2?

A court approved a name change in November 2025. The employee ended employment prior to the name change but the Employer prepared the W2 with the new name (the individual started working with the same employer in 2026). Should the employer prepare the 2025 W2 with the old name or the new name? The employee has not reported the name change to the Social Security as of now.

I dont think it really matters in the grand scheme of things, I have people that come in with W2s in their prior last name often, as long as the SSN is correct, just go with it.

The tax return needs to use the name that SSA has on file, or you'll get a name/SSN mismatch rejection.

@Just-Lisa-Now-  Isn't it more of a problem for the employer?  If the W-2 name doesn't match the SSA name, won't the employer get dinged?  And maybe ICE will be notified of possible identity theft by undocumented workers.

I see women that have their wrong name on their W2 for multiple years in a row, Im not sure if IRS actually catches these, but yes it would be the employers problem...I have no clue how ICE plays into this, youd think the employers would be in trouble for employing people with fake paperwork, but we dont see that happening at all.
