How do I calculate OT premium for UPS long haul drivers

Client works for UPS and makes OT but company does not calculate.  His OT is based on any day over 8 hours, not over 40 hour week. Anyone have similar clients?

if the company doesn't calculate then how does he get paid for it? They don't have some type of report they can give him. Is he a UPS employee or contractor with a 1099?

He is a ups employee.  There is nothing on his w2 and the company does not respond to his questions.

Are UPS drivers subject to FLSA laws?  I suspect they are not, perhaps that's why the ER didn't compute. For 2025 (only) the employer does not have to put the info in Box 14 of the W-2.  The employer is required to inform the employee of the qualified overtime in some manner.

Only OT on hours in excess of 40 hours per week - subject to FLSA laws per OBBB - qualify for the deduction.

OT on hours in excess of 8 hours does NOT qualify for the deduction.  That is generally a State mandated OT law.

that may be the problem.  They don't do straight weeks.   They are long haul.  They can work 4 days and off 2.  So if they work a 12 hour day then they are not entitled to it.

Most over-the-road truck drivers are not covered by FLSA overtime.  See the DOL's fact sheet #19 (see link below).

His OT pay is put on his pay stub if he is a W2 employee, so just look at his last pay stub. I've seen pay stubs from UPS, and it is on there for nonexempt employees.
