The CARES Act increased the section 163(j) 30% ATI limitation to 50%, but form 8990 from irs.gov is still revision 12-2019 with 30% and I don't see any indication that IRS will update this form. Revenue Procedure 2020-22 allows taxpayers to elect to use 30% by filing a tax return with the 30% ATI limitation, so form 8990 rev. 12-2019 can be used as a final form for taxpayers making this election. However, PTO issues a critical diagnostic indicating form 8990 is in draft form. I'd like to e-file a return with the 30% ATI limitation using form 8990 that PTO considers "draft" as a final form to make this election. Is there a way to avoid the critical diagnostic? It looks like I can e-file with the diagnostic, but the "draft" form is valid in this circumstance and I'd like to eliminate the critical diagnostic and not just ignore it if possible.
