Can legal fee paid for Employment disability discrimination law suit deduct?

Hi,

I have a client filed Employment disability discrimination law suit against formal employer,

then win, received pay  $90k as W2 income. The legal fee is about $40k, I realized the 2% misc deduction is no longer allowed on Sch A. 

Where can the legal fee deduicted?
