Moving Expenses

I have a client who is a first time home buyer. On the T1-M, it states: 

Cost of buying the new home: You can claim the expenses on lines 21 and 22 only if you or your spouse or common-law partner sold the old home because of the move.

Does this mean that if you didn't have an old home to sell, you can not claim legal costs for buying your home? Or does it mean that if you had an old home to sell, but didn't sell it, then you couldn't claim legal costs on the purchase of the new home?

you had to have sold the old home. can't claim lines 21/22 without having an old home AND selling it.
