Lawsuit settlement partly physical injury.

The taxpayer filed a lawsuit in a school setting re: bullying with physical injury. The attorney neglected to send her a date for a hearing so when she didn't appear the case was thrown out. She then sued the attorney and won a large settlement. Do you think this be construed as still on the basis or physical injury? I'm anxious to hear what the community has to say about this. She does not know if she will receive a 1099. I would hazard a guess she will.

Any thoughts would be be helpful. .Thank you.

I think the only potential physical injury part of that deal is if she beat up the attorney when she found out the case was thrown out.
