Question

How do you file a Form 541 (CA Fiduciary return) that includes foreign beneficiaries with no ID numbers?

When you have withholding for nonresident beneficiaries on the amount of distribution deduction reported on Form 1041 you enter “Form1042S” on the Social Security Number line for each beneficiary, but California rejects the return with that information.  Does anyone know if there is a workaround?  How to Efile the CA Form 541 without beneficiary TINs or EINs or SSNs?

Hi @CLWLaw thanks for posting in the Community about how to e-file CA Form 541 without beneficiary TINs or EINs or SSNs. Is the exact error you are receiving for CA—When you have withholding for nonresident beneficiaries on the amount of distribution deduction reported on Form 1041 you enter “Form1042S” on the Social Security number line for each beneficiary? If you provide the rejection number, also, it might help the community to better assist with it. We did a search to see if this was allowed for CA, but we don't see anywhere where it is stated that it is. If there's no replies here, we’d recommend reaching out to the FTB for further guidance. If the return keeps getting rejected, we'd have to recommend paper-filing it.

Form 541 with K-1s cannot be filed electronically without a SSN, TIN, or EIN entered, unlike Form 1041, which allows “Form1042S” to be entered in the EIN space.  The California return was ultimately filed on paper.
