Can an estate tax return for someone who dies early in 2022 be prepared in the 2021 program

Yes, but ....

It is set up for death in 2021 and there are no overrides for the new exclusion of 12.06million. You will likely then have to redo at least page one manually on a pdf. Fortunately IRS provides this for us https://www.irs.gov/pub/irs-pdf/f706.pdf
